NPE Case Management: A Lifecycle Guide for Patent Attorneys

Non-provisional patent application (NPE) case management is the operational core of patent prosecution. Once a non-provisional is filed, the case enters a multi-year prosecution lifecycle - office actions, responses, examiner interviews, allowances, issue fees, and post-grant maintenance.   4. First office action - examiner issues initial rejection or allowance

  6. Subsequent office actions - may be final or non-final, may include restriction requirements

  8. Notice of allowance - examiner allows the application
  9. Issue fee payment - 3 months from notice of allowance
  10. Issuance - patent grants and enters maintenance phase
  11. Maintenance fees - due at 3.5, 7.5, and 11.5 years after grant in the US

A typical non-provisional spends 2-4 years in prosecution. During that time, the responsible attorney may rotate, the inventor may leave the company, the business strategy may shift. The case management system has to provide continuity that the people involved cannot.

Office Action Tracking

The single most important NPE workflow is office action management. Every office action triggers a response deadline, typically 3 months with the option to extend up to 6 months at additional cost. Missing the extended deadline causes abandonment.

  • Office action receipt date - the clock starts here
  • Statutory response deadline - 3 months from receipt for the USPTO
  • Extended deadline - up to 6 months with extension fees
  • Extension cost progression - month 4 is cheapest, month 6 is most expensive
  • Rejection types - 102 anticipation, 103 obviousness, 112 indefiniteness, restriction requirements - each requires different response strategy
  • References cited - prior art the examiner relied on, which must be addressed in the response
  • Examiner identity - examiner allowance rates and interview willingness vary widely

Modern NPE management surfaces upcoming response deadlines with urgency color coding - green for on track, amber for due soon, red for overdue or imminent. This visual triage lets the team focus attention where it matters most.

Annuity and Maintenance Fee Management

Once a non-provisional grants, the case enters the maintenance fee phase. In the US, maintenance fees are due at 3.5, 7.5, and 11.5 years after grant. Each fee has a 6-month surcharge window after the due date; missing the end of the surcharge window causes permanent abandonment.

Other jurisdictions use annual annuities starting from filing date or grant date, with steeply escalating fees in later years.   • An allowance in one jurisdiction may inform claim strategy in pending national phases

Examiner Interview Tracking

Examiner interviews are an underutilized tool. A 30-minute interview can resolve issues that would otherwise require multiple rounds of written responses. Tracking interview participants, agreements reached, and follow-up actions creates institutional knowledge that survives attorney turnover.

Common NPE Management Failures

  • Missed response deadlines - the most common cause of unintended abandonment. Always caused by inadequate deadline tracking, not attorney negligence.
  • Lost office action references - cited prior art that the responding attorney never received from the docketing team.
  • Inconsistent claim strategy across families - different attorneys taking different approaches in related cases, creating prosecution history risks for later litigation.
  • Surprise abandonment - a case quietly going abandoned because no one was tracking the surcharge window.
